Under Japan’s utility model system, which has no substantive examination so as to grant rights as quickly as possible, utility model rights may not be exercised unless the JPO provides a Report of Utility Model Technical Opinion regarding the registered utility model. The report is an assessment in which an examiner of the JPO assesses such factors as the novelty and inventiveness of the device, based on the results of a prior-art search, so as to evaluate the effectiveness of the right.
